Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Sentence Master and any related websites, apps, or services (collectively, the “Service”). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the minimum age in your country) to use the Service. If you are under the age of majority, you must have your parent or legal guardian’s consent.
2. Your Account
- You are responsible for the activity that occurs under your account and for keeping your credentials secure.
- You agree to provide accurate information and to comply with applicable laws and these Terms.
- We may refuse, suspend, or terminate the Service to anyone at our reasonable discretion, subject to applicable law.
3. License and Acceptable Use
- We grant you a limited, personal, revocable, non‑exclusive, non‑transferable license to use the app for your own learning.
- You will not: (i) copy, modify, or create derivative works of the Service; (ii) reverse engineer or attempt to extract source code; (iii) access the Service by automated means (scrapers, crawlers) except as permitted; (iv) upload unlawful, infringing, or harmful content; (v) interfere with or disrupt the Service; (vi) bypass or violate security or usage limits.
4. Your Content
You retain ownership of the content you submit (e.g., sentences, recordings). You grant us a worldwide, non‑exclusive license to host, process, and display your content solely to operate the Service and provide features you choose. You represent that you have the necessary rights to submit the content.
5. AI Features
The Service may generate automated suggestions, corrections, or scores. AI outputs may be inaccurate or incomplete; you should review them carefully and use judgment. We may process your inputs to provide these features as described in our Privacy Policy.
6. Purchases, Trials, and Subscriptions
- Premium features (if offered) are billed by Apple App Store or Google Play, and those stores’ terms govern purchases, renewals, and refunds.
- Subscriptions renew automatically until you cancel in your store account settings before the renewal period. Some features may become unavailable when a subscription ends.
- We may change prices or features, with notice where required by the stores or by law.
7. Changes to the Service
We may add, change, or remove features and may suspend or discontinue the Service at any time. If changes are material, we will provide notice in‑app or by email when appropriate.
8. Intellectual Property
We and our licensors own the Service and its content (excluding your content). Except for the limited license above, these Terms grant no rights to our trademarks, logos, or other IP.
9. Feedback
If you send ideas or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty‑free license to use them without restriction and without any obligation to you.
10. Third‑Party Services
The Service may integrate with or link to third‑party services (e.g., app stores, hosting, analytics, speech/AI processors). Their terms and privacy policies apply to their services.
11. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
12. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages; or for lost profits, revenues, or data; or for business interruption. Our aggregate liability for claims relating to the Service will not exceed the greater of (a) USD $100 or (b) the amounts you paid for the Service in the 12 months before the claim arose.
13. Indemnification
You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of these Terms or applicable law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary for security, legal, or operational reasons. Upon termination, certain provisions survive, including Sections 8–13 and 16–18.
15. Governing Law and Venue
These Terms are governed by the laws of the State of California, USA, without regard to conflict‑of‑laws rules. The courts located in San Francisco County, California have exclusive jurisdiction over disputes arising out of or relating to the Service or these Terms.
16. Export and Sanctions
You must comply with all applicable export control and sanctions laws. You may not use the Service if you are located in or are a resident of a jurisdiction embargoed by the United States or if you are on a U.S. government restricted list.
17. DMCA / IP Complaints
If you believe content infringes your rights, contact smile@thinksview.com with details and we will respond as required by law.
18. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice in‑app or by email when appropriate. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
19. Miscellaneous
- Entire agreement: these Terms are the entire agreement between you and us regarding the Service.
- Severability: if any provision is found unenforceable, the remaining provisions remain in full force.
- Assignment: you may not assign these Terms without our consent. We may assign these Terms as allowed by law.
- No waiver: failure to enforce a provision is not a waiver.
